RRD Partner John F. Costa Prevails on behalf of Health Care Provider in Supreme Court

RRD partner John F. Costa and associate Liam M. West recently prevailed in the Connecticut Supreme Court on behalf of a defendant health care provider who allegedly failed to properly treat the plaintiff’s predilection for viewing child pornography.

RRD’s victory before the Supreme Court followed a successful motion to strike at the trial court level. In its opinion affirming the trial court decision, the Supreme Court agreed with RRD that the plaintiff could not recover for mental distress or economic damages arising from the legal consequences of the plaintiff’s serious criminal conduct. In its opinion, the Supreme Court determined that it would violate public policy to impose a duty on the defendant health care provider to protect the plaintiff from any injuries resulting from the plaintiff’s own criminal behavior.
