STAMFORD, CT – (November 17, 2010) – RRD senior associate James A. Mahar recently obtained a dismissal of a claim brought against a local school board under the Age Discrimination in Employment Act (ADEA), 29 U.S.C. § 621 et seq.
The plaintiff was a former assistant principal of a middle school who claimed he took early retirement because the school board, through its agents, created a hostile work environment due to his age, thereby “constructively discharging” him from his position.
The matter was brought in the United States District Court for the District of Connecticut. In granting the defendant’s Motion to Dismiss, the Court held that the plaintiff failed to allege sufficient facts to support an inference that the defendant “deliberately created working conditions so unpleasant or difficult that a reasonable person would have felt compelled to resign,” and, as such, were “insufficient to support a plausible claim that he was constructively discharged because of his age.”
