Attorney Ryan C. Ing Secures Third Consecutive Defense Verdict in Stamford Superior Court

Ryan Ryan Deluca is pleased to report another defense verdict obtained by Attorney Ryan C. Ing in the matter of Duarte v. Rivera’s Landscaping LLC and Mario Alberto Estrada-Macias, tried in the Connecticut Superior Court, Judicial District of Stamford/Norwalk.

The case arose from a July 21, 2021 motor vehicle accident on Danbury Road in Wilton, Connecticut. The plaintiff alleged that while her vehicle was stopped in traffic waiting to turn into a gas station, she was struck from behind by a vehicle operated by an employee of Rivera’s Landscaping LLC. The plaintiff claimed the collision resulted from the negligence of Rivera’s Landscaping LLC’s employee. The plaintiff alleged that she suffered permanent and life altering cervical and lumbar spine injuries, aggravation of pre-existing spinal conditions, emotional distress, and loss of earning capacity. She sought significant damages for medical expenses, lost wages, and other claimed losses.

The defendants denied the allegations of negligence and disputed the nature and extent of the injuries claimed by the plaintiff. This trial, and the motion practice leading up to it, involved significant evidentiary issues, in which the defense ultimately succeeded.  During trial, the defense challenged the plaintiff’s alleged damages and in closing, argued that the plaintiff failed to meet her burden of proof as to negligence and causation.

Following a five-day trial, on January 28, 2026, the jury returned a verdict in favor of the defendants on all counts. The verdict was accepted by the Court, resulting in no damages awarded to the plaintiff.
