RRD Obtains Favorable Verdict for Long Term Care Facility

RRD partner  John F. Costa obtained a favorable verdict in favor of a Long Term Care facility in a case in which liability had been conceded prior to trial. The nursing facility did not dispute that the negligence of one of its aides caused the resident to sustain a compound fracture of the tibia and fibula which required surgical repair. The aide was terminated as a result of the incident.  A  verdict was returned for just more than half of the last settlement offer which the defendant had extended prior to trial. The defense submitted extensive documentation from the resident’s subsequent facility where she was transferred to which proved limited pain and suffering and severe dementia.
